Condo mold: who handles what

In a Florida condo, the association maintains the common elements (s. 718.113(1)). The association's insurance excludes unit finishes such as floor and wall coverings, cabinets and appliances (s. 718.111(11)(f)), and owners insure those (g). After an insurable event, the association generally repairs unless an owner's negligence caused the damage (j).

In practice: a leak from the roof or a shared pipe usually starts with the association; mold in your cabinets from your own dishwasher usually starts with you. Read your declaration and talk to your manager in writing. This is general information, not legal advice. The condo mold page goes further.

Milton, Helene and closed-up units

Milton came ashore on Siesta Key at about 8:30 p.m. on October 9, 2024, as a Category 3 hurricane, causing major damage in the Sarasota and Tampa Bay areas (National Hurricane Center). Helene's surge had hit the same coast two weeks earlier.

For seasonal owners, the slower risk is a unit left with the AC off or set high through a wet summer. Sarasota averages about 49 inches of rain a year, about 60% of it from June through September (NOAA 1991–2020). See how to keep mold out of a closed-up home.

Checking the company

Florida licenses mold assessors and mold remediators through the Department of Business and Professional Regulation (DBPR) under Chapter 468, Part XVI. Before you hire, look up the company's license at myfloridalicense.com (search by name or license number). Some contractors are exempt; ask which license covers the work.

In Florida, a company that does the mold assessment generally can't also do the remediation on the same structure within 12 months, and vice versa (s. 468.8419). The licensing law covers mold growth over 10 square feet (s. 468.8411).

Published national estimates, not quotes: HVAC and duct work $3,000 to $10,000; walls $1,000 to $12,000 (Fixr, Aug 2025). Condo building rules on work hours and access can affect scheduling. See the cost guide.

Siesta Key mold questions

Mold showed up in my Siesta Key condo while I was away. Is it the association's problem or mine?

It depends on the source and your declaration. Under Florida law the association maintains the common elements (s. 718.113(1)), and its insurance excludes unit finishes such as floor and wall coverings, cabinets and appliances, which owners insure (s. 718.111(11)(f), (g)). Read your declaration and notify the manager in writing. This is not legal advice.

What AC setting keeps mold out of a closed Siesta Key unit?

There is no single number, but the goal is indoor humidity below 60%, ideally 30 to 50%, as EPA suggests. Leaving the AC running, rather than off, is the usual approach. A humidity monitor you can check remotely, a clear condensate line and a neighbor or manager who looks in during summer all help.

Are permits handled by the city or the county on Siesta Key?

It depends on your address. The northern part of Siesta Key is inside the City of Sarasota, which requires permits for most work. The rest is unincorporated Sarasota County, where replacing drywall more than 2 feet above the floor needs a permit (Building Official letter, October 2024). Your rebuild contractor should confirm and pull any permit.
