Common causes of mold in rentals

  • A roof or window leak that wasn't repaired after a storm.
  • A plumbing leak in a wall, under a sink, or from the unit above or next door.
  • An AC condensate line that backs up into a closet or ceiling.
  • A bathroom with no working exhaust fan.
  • A unit left vacant with the AC off between tenants.

Many Sarasota-area rentals are in larger buildings. In the City of Sarasota, 28.8% of housing units are in buildings with 20 or more units (American Community Survey 2020–2024). In those buildings, one unit's leak can become a neighbor's mold, and the association may be involved too. See condo mold.

What Florida law generally says (not legal advice)

Florida's landlord-duty statute (s. 83.51) doesn't name mold. In plain words, and hedged:

  • s. 83.51(1): the landlord must comply with applicable building, housing and health codes. Where none apply, the landlord must keep structural components and plumbing in good repair.
  • s. 83.51(2)(a): for apartments (not single-family homes or duplexes), unless agreed otherwise in writing, the landlord also handles items such as extermination, safe common areas and running and hot water.
  • s. 83.51(4): the landlord isn't responsible for conditions caused by the tenant, family or guests.
  • s. 83.56(1): if the landlord materially fails to comply, a tenant may end the lease if the problem isn't fixed within 7 days after written notice that describes it and states the intent to terminate.
  • s. 83.60: withholding rent can be a defense to eviction only after a 7-day written notice stating the intent to withhold. In an eviction, a tenant generally must deposit the rent into the court registry, or may lose defenses other than payment.

Put it in writing; don't withhold rent without advice. The 7-day clock only starts with written notice, and the court-deposit rule is strict. A local legal aid office or a Florida landlord-tenant lawyer can tell you how the law applies to your lease.

Steps for renters

  1. Document it

Take dated photos of the mold and any leak or stain, and note when you first saw or smelled it.

  2. Notify in writing

Send the landlord or manager a written notice describing the problem. Keep a copy and proof of delivery.

  3. Limit the damage

Run the AC and bath fans, wipe condensation, and report new leaks right away. Don't paint over mold.

  4. Get advice before big moves

Before ending the lease or withholding rent, talk to legal aid or a lawyer about ss. 83.56 and 83.60.

Steps for landlords and managers

Respond in writing, find and fix the water source, and get the mold handled. Ask the company for a written plan and a record of what was removed. If the unit is a condo, check whether the source is a common element the association maintains (s. 718.113(1)). Landlords in Sarasota, Bradenton, Venice and nearby towns can request quotes with the same form.

What rental mold work costs

Health note

EPA and CDC describe mold's main health effects as allergic and irritant reactions, such as a stuffy nose, itchy eyes, coughing or wheezing. People with asthma, allergies or weakened immune systems may be more sensitive. If anyone in the home has symptoms, see a doctor.

If someone in the home is sensitive, say so in your written notice.

When to call a company and when to clean it yourself

Florida's mold-licensing law covers mold growth over 10 square feet (s. 468.8411). For smaller areas, EPA says you can usually clean it yourself. Homeowners may also work on their own home (s. 468.841). Tenants should check the lease and tell the landlord before cleaning, since the cause may need a repair only the landlord can make.

Get quotes when the area is bigger than about 10 square feet, when it returns after cleaning, when it follows a leak inside a wall or ceiling, or when it involves the AC system (see AC and HVAC mold).

Questions to ask before you hire

Florida licenses mold assessors and mold remediators through the Department of Business and Professional Regulation (DBPR) under Chapter 468, Part XVI. Before you hire, look up the company's license at myfloridalicense.com (search by name or license number). Some contractors are exempt (s. 468.841); ask which license covers the work.

In Florida, a company that does the mold assessment generally can't also do the remediation on the same structure within 12 months, and vice versa (s. 468.8419). That separation can help in a rental dispute, because the company testing has no stake in the removal job.

  • The company's DBPR license number. Look it up at myfloridalicense.com before you sign.
  • A written contract signed by both sides (s. 468.8422).
  • Proof of insurance (the law requires $1,000,000 general liability, s. 468.8421).
  • A written assessment or remediation plan: what will be removed, cleaned or left, and how the area is contained.
  • If you want a clearance test after the work, an independent assessor from a separate company.

Rental mold FAQ

Is my landlord responsible for mold in Florida?

Florida's landlord-duty statute (s. 83.51) doesn't name mold. It does require landlords to follow building, housing and health codes and keep the structure and plumbing in good repair. Leaks that cause mold are often the landlord's to fix, but not conditions the tenant caused (s. 83.51(4)). This is general information, not legal advice.

How do I report mold to my landlord?

Put it in writing. Describe where the mold is, when you noticed it, any leak you know of, and include dated photos. Florida's tenant remedies run on a 7-day written notice (s. 83.56(1)). Keep a copy and proof of delivery, and keep paying rent while you sort it out unless a lawyer or legal aid office advises otherwise.

Can I withhold rent because of mold in Florida?

Only under strict conditions, and it is risky. Under s. 83.60, the landlord's failure to make required repairs can be a defense in an eviction only after a 7-day written notice stating your intent to withhold rent. In an eviction, you generally must pay the rent into the court registry. Get legal advice first.

Can a landlord handle mold without hiring a mold company?

Florida's mold-licensing law covers growth over 10 square feet. An owner may do mold work on property it owns, unless it is in the business of doing mold work for the public (s. 468.841). For larger jobs, many landlords hire a remediator and check its DBPR license at myfloridalicense.com.
